Do PUWER and LOLER regulations still apply now the UK has left the EU and what does this mean for users of work at height equipment such as MEWPs?

Lifting Operations and Lifting Equipment Regulations 1998 (LOLER) and The Provision and Use of Work Equipment Regulations 1998 (PUWER) covers a wide range of work equipment, including MEWPs. Read more about LOLER and PUWER on our blog. 

The HSE shared a recent update on their website about any regulations and procedures which have been affected by the departure from the EU: 

“The UK has left the EU, and rules and procedures have changed for some industries.

Your responsibility to protect the health and safety of people affected by your work activities remain.

There are some new rules and procedures you must follow to continue to place chemicals, civil explosives and work equipment and machinery on our domestic market.”

After the transition period LOLER and PUWER will remain in place and Brexit is unlikely to affect UK inspections of lifting equipment, pressure systems and all other work equipment and these regulations will keep their status in UK law after the transition period.

LOLER and PUWER inspections for MEWPs

HLS provide service inspections of the above, as required by UK legislation, namely LOLER and PUWER. 

To meet your legal obligation under these regulations, you will need to carry out pre use checks, weekly examinations and more extensive examinations, undertaken every few months or longer.  A thorough examination should be carried out at the intervals specified by LOLER (every 6 or 12 months, depending on the equipment.) 

It is important to maintain thorough examination and testing within the required time period. 

As part of the inspection, our engineers will advise you of any repairs needed to bring them up to scratch so that you can decide how to move forward. We’ll also provide you with all of the documentation you need to show that you’ve maintained your certification.

PUWER/LOLER certification, servicing and repairs will be carried out in line with Government guidelines. Our priority all times is to keep you, your employees and our own staff engineers safe and well and productive when working at height.
